Land Use Covenants
Under federal and state laws, remedial action plans and/or environmental cleanups are required for a site where there has been a release or threatened release of a hazardous substance into the environment. While the general goal of most environmental cleanups is to return a site to a condition where people can safely use it for any purpose, this is not always technically possible or economically feasible.
A practical alternative to environmental cleanups is executing and recording a Land Use Covenant (“LUC”). A LUC is a legal instrument that restricts activities on sites where some contamination remains in place, and binds current and future landowners. A LUC can protect human health and the environment while encouraging economic development of the site. LUCs provide reliable long-term controls, reducing the risk that a future owner might eliminate the controls and thereby increase or revive the first owner’s liability. LUCs also allow for the redevelopment, sale, and productive use of the site, thereby increasing the value of the site.
DiJulio Law Group has expertise in preparing and negotiation LUCs and other environmental land use controls. We have found that by tailoring the LUC to the specific contaminated area of the site, rather than the entire site or parcel, it can lower the site owner’s burden and liability, and promotes the value of the site, saving thousands of dollars in future cleanup costs.
